These Terms of Service (the “Terms”) govern your use of Catalog Canary (the “Service”), operated by Proven.Digital (“we, ” “us,” “our”). By installing or using the Service you agree to these Terms. If you do not agree, do not install or use the Service.
1. The Service
Catalog Canary monitors changes to Shopify product and collection data on your behalf, records a history of those changes, sends optional notifications, and provides one-click revert for supported field types. The exact features and limits available to you depend on your active subscription plan, as described inside the app and on the Shopify App Store listing.
2. Eligibility
You must operate a Shopify store and be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By installing, you represent that you have authority to bind the owner of the Shopify store you install the app on.
3. Subscriptions, pricing, and billing
Pricing for paid plans is shown inside the Shopify App Store listing and in the app's Billing page. All charges are processed by Shopify under its Managed Pricing system. By subscribing you agree to the recurring monthly charges associated with your selected plan.
Trial periods, if offered, are described at the time you select a paid plan. You may downgrade or cancel at any time through Shopify's admin or by uninstalling the app. Refunds for partial billing periods are at Shopify's discretion under its policies; we generally honor Shopify's decisions on refund requests.
4. Plan limits
The Free plan limits monitoring to a fixed number of products. If you exceed that limit, the Service stops tracking new products you add to your store until you upgrade. Existing tracked products are unaffected. Other plans have higher limits as described on the listing.
5. Accuracy and availability
We use Shopify's webhook system and a scheduled polling fallback to detect changes. Although the Service is designed to detect every change, we cannot guarantee 100% coverage in cases of Shopify webhook failures, network interruptions, or other circumstances outside our control. The Service is provided on a best-effort basis without an availability service level agreement.
6. Acceptable use
You agree not to:
- Use the Service to monitor or store data from Shopify stores you do not own or have authorization to access.
- Attempt to reverse-engineer, decompile, or extract the source code of the Service except where expressly permitted by law.
- Use the Service to send unsolicited communications or for any unlawful purpose.
- Circumvent or attempt to circumvent the plan limits described in Section 4.
- Use the Service to create a competing product or service.
We may suspend or terminate your access if you violate these terms or the policies of the Shopify Platform.
7. Your data
Your use of the Service is also governed by our Privacy Policy, which describes what data we collect and how we handle it. You retain ownership of all data belonging to you that flows through the Service. We do not sell your data or use it to train machine-learning models.
8. Intellectual property
The Service, including all source code, design, branding, and documentation, is owned by Proven.Digital and protected by intellectual-property laws. These Terms grant you a limited, non-transferable, non-exclusive license to use the Service while your subscription is active.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.
The Service is not a substitute for backing up your own data. We strongly recommend that you maintain independent backups of your Shopify catalog through Shopify or another tool.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.
12. Termination
You may terminate these Terms at any time by uninstalling the app from your Shopify store. We may suspend or terminate your access for violations of these Terms, fraud, security risk, or non-payment. Sections 7–11 survive termination.
13. Changes to the Terms
We may update these Terms as the Service evolves. Material changes will be announced inside the app. The effective date at the top of this page reflects the latest revision. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Florida.
